14.12.2020 Sdas rejected C.R.M. 2636 of 2020 (via video conference) In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Basirhat Police Station Case No. 769 of 2019 dated 03.08.2019 under Sections 21(C) of the N.D.P.S. Act.

And In Re : Soumajit Nandi .... petitioner Mr. Satadru Lahiri ....for the petitioner Mr. Binay Panda Ms. Puspita Saha ...... for the State Petitioner is in custody for one year and five months. Learned Counsel appearing for the petitioner prays for bail.

Learned Counsel appearing for the State submits that chemical report has been placed before the trial court. Statements of the witnesses disclose recovery of narcotic substance above commercial quantity from the petitioner.

In view of the aforesaid fact, statutory restrictions under Section 37 of the N.D.P.S. Act and as the hindrance for progress in the matter due to non-submission of chemical report no longer exists, we are not inclined to grant bail to the petitioner. The application for bail is, thus, rejected.

Trial court is directed to proceed with the matter with utmost expedition.
