The petitioner is the daughter of a deceased Sahayika in Majpur Tantipukur Manasha Mata Sishu Siksha Kedra, P.S. Khanakul, District-Hooghly. The mother of the petitioner diedin-harness on January 22, 2021. The petitioner applied for appointment on compassionate grounds to this Sishu Siksha Kendra on the basis of a resolution adopted by the Sishu Siksha Parichalan Committee dated February 8, 2021. Learned Advocate for the State-respondents has submitted a report prepared by the Executive Officer, Khanakul-I Panchayat Samity, Khanakul, Hooghly. It appears that the application of the petitioner was misconceived as recruitment to such Sishu Siksha Kendras are made by the

concerned department and neither by the Executive Officer or the Parichalan Committee and as such the application of the petitioner for compassionate appointment cannot be considered. The report is taken on record.

Records do not reveal that the petitioner has applied in the prescribed form before the appropriate authorities. Records also do not reveal that there is a scheme for compassionate appointment in such cases, which have been applicable to the Sishu Siksha Kendras.

The petitioner is entitled to know about the fate of the application pending before the Executive Officer, Khanakul-I Block, Hooghly dated February 12, 2021.

The writ petition is disposed of with a direction upon the Executive Officer, Khanakul-I Block, Hooghly, to intimate the petitioner the reasons as to why the application of the petitioner could not be entertained by the said authority. Such decision with reasons shall be sent within a period of one month from the date of communication of this order. In the decision, it shall be disclosed whether any scheme for appointment on compassionate grounds on the death of a Sahayika or Samprasarika of a Sishu Siksha Kendra, has been adopted or not for such institutions and also who was the competent authority to make such recruitment, if permissible as per the scheme.

This writ petition is, thus, disposed of.

There will be no order as to costs.

All parties are to act on the basis of the server copy of this order.
