Learned Advocate for the petitioner prays for expediting the evidence of Misc. case 42 of 2021 pending before the Learned Chief Judicial Magistrate, Purulia.

Learned Advocate appearing for the petitioner submits that the conduct of the applicant before the Learned Trial Court is questionable in view of the fact that immediately after the Hon'ble High Court passed an order, the application for interim maintenance was prayed for withdrawal before the Learned Trial Court.

Mr. Mukherjee, learned advocate appears for the opposite party and submits that since before a higher forum submission was advanced, as such in the fitness of circumstances, the applicant before the Learned Trial Court withdrew the application for interim maintenance and there is nothing wrong in such prayer being made. Dates have been fixed for the proceeding. In view of the submission advanced by the Learned Advocate for the parties, I direct the Learned Trial court to fix at

least one date in a month so that the trial of the case can be taken to its logical conclusion within a reasonable period of time. No unnecessary adjournments should be granted to either of the parties and all steps be taken so that for concluding the trial of the case.

With the aforesaid observations, CRR 1041 of 2022 is disposed of.

All pending connected applications, if any are consequently disposed of.
