Petitioner has challenged the continuance of Budge Budge Police Station Case No. 166 of 2023 dated 01.06.2023 wherein the investigating agency on conclusion of investigation, submitted charge-sheet under Sections 341/325/506 of the Indian Penal Code. On perusal of the charge-sheet, I find that there are allegations in respect of injuries being inflicted and a doctor is also a witness in the list of witnesses. Having regard to the same and that none of the documents under Section 207 of the Code of Criminal Procedure being enclosed, I grant liberty to the petitioner to take up all the issues canvassed in the present revisional application at the stage of consideration of charges.

If an application under Section 239 of the Code of Criminal Procedure is filed before the learned Magistrate/Trial Court, the learned Trial Court will consider the same in accordance with law independently without being influenced by any observations made by this Court. With the aforesaid observations, the revisional application being CRR 960 of 2024 is disposed of. Pending connected application, if any, is consequently disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
