Learned advocate appearing for the petitioner submits that petitioner is in custody since 24th of November, 2025 and has been shown arrested in the present case. Surprisingly, the land where the recovery has been made do not belong to the present petitioner and from a bunker allegedly 62000 bottles of phensedyl were recovered. Learned DSGI, appearing for the NCB submits that there were recovery of 62000 bottles of phensedyl and there are materials in the Case Diary to support the proximity of the petitioner within such cross-border contraband smuggling. Learned advocate further submits that date has been fixed for consideration of charges. Having regard to the quantum of seizure and the fact that complaint has been filed and some of the accused persons are still absconding, I am not inclined to release the petitioner on bail at this stage.

Learned advocate for the petitioner complains that the copies have not been supplied. In case, the same has not been complied with, the learned Special Court would ensure that prior to framing of charge the documents are supplied.

Accordingly, CRM (NDPS) 494 of 2026 is dismissed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
