1. This is a writ petition of the year 2009.

2. None appears on behalf of the petitioner at the time of call. No accommodation is sought for either.

3. The learned advocate for the bank submits that the learned on record of the petitioner refused to accept the copy of the affidavit-in-opposition and the copy of the affidavit-of-opposition has been served upon the petitioner directly through Speed Post. Affidavit of service filed in Court today showing service of the copy of the affidavit-in-opposition upon the petitioner is taken on record.

4. Record reveals that the petitioner was also not represented on 11th June, 2024. It appears that the petitioner is not interested to proceed with this writ petition any further.

5. In view thereof, writ petition stands dismissed for default.

6. Interim order, if any, stands vacated.

7. No costs.

8. Urgent photostat certified copy of this order, if applied for, be furnished to the parties expeditiously upon compliance of all legal formalities.
