25.04.2022 Sl. 44 Court No.29 suvayan (rejected) C.R.M. (NDPS) 333 of 2022 In Re: - An application for bail under Section 439 of the Code of Criminal Procedure in connection with Murshidabad P.S. case No. 543/2020 dated 22/10/2020 under Sections 21(c)/29 of the Narcotic Drugs and Psychotropic Substances Act. And In the matter of: Aroj Ali ....petitioner.

Mr. Tapodip Gupta ...for the petitioner.

Mr. Sujan Chatterjee ...for the State.

Petitioner seeks bail.

Considering the fact that the police obtained the chemical report and submitted the same by way of supplementary chargesheet and considering the fact that commercial quantity of narcotic was recovered from the possession of the petitioner, we are of the view that the petitioner is unable to overcome the restrictions under Section 37 of the Narcotic Drugs and Psychotropic Substances Act, 1985.

Consequently, we are unable to grant bail to the petitioner. Accordingly, the prayer for bail of the petitioner is rejected. C.R.M. (NDPS) 333 of 2022 is dismissed.
