Petitioner complains that in spite of Kaliachak Police Station Case No. 1969/2024 pending under the relevant provisions of BNS, the police authorities have neither recovered the child nor arrested the accused persons.

So far as the investigation is concerned, police authorities have already submitted charge sheet as is reflected from the report submitted by the Inspector-in-charge, Kaliachak Police Station. In course of investigation three persons were implicated out of which two of the accused persons were released on court bail and the husband, Aslam Khan was arrested on the strength of warrant of arrest and was produced before the court.

So far as return of the child is concerned, on 18.03.2025 the child has been returned to the present petitioner being the mother of the child as is reflected from the report. In view of the issues canvassed in the writ petition being addressed by the police authorities, no cause of action remains for considering the grievance of the petitioner.

Accordingly, WPA 5902 of 2025 is disposed of.

Report so submitted be kept with the record.

A copy of the report be handed over to the learned advocate appearing for the petitioner. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
