This is an application for release of a vehicle seized in connection with Bagdah Police Station Case no. 445 dated 06.08.2020 under Sections 27/27A of the Drugs and Cosmetics Act, 1940. By the impugned order dated January 19, 2021, the learned Magistrate in the Court below declined to entertain the prayer for release the vehicle.

Pursuant to the order dated July 30, 2021, a report has been filed on behalf of the State. The report suggests that the vehicle in question belongs to the petitioner, who is the registered owner of the same.

No specific objection has been raised as against the release of the vehicle by the State in the report.

Charge sheet has already been filed.

In the view of the said report, this application for release of the vehicle having Registration No. WB28C-3322 stands allowed. The order dated January 19, 2021, passed by the learned Additional Chief Judicial Magistrate, Bongaon is set aside. The relevant vehicle may be released subject to furnishing a bond of Rs. 30,000/- by the petitioner before the learned Magistrate in the Court below. The petitioner shall produce the vehicle as and when called for by the learned Magistrate. The report filed in the Court be kept with the record.

The revisional application being CRR 681 of 2021 is, thus, disposed of.
