CRIMINAL REVISIONAL JURISDICTION APPELLATE SIDE ( Via Video Conference ) CRR 767 of 2012 In the matter of : Smt. Payel Banerjee ........Petitioner. In Re : An application under Sections 482 of the Code of Criminal Procedure.
The revisional application was preferred in connection with the Complaint Case No.45988 of 2009 pending before the learned Metropolitan Magistrate, 13th Court, Calcutta.
The record of the revisional application reflects that the interim order was extended for a period of six weeks by a co-ordinate Bench of this court on 12th October, 2012. As such, from December, 2012 there has been no interim order restraining the proceedings before the learned trial court to continue with the same.
Having regard to the fact that the revisional application has been preferred regarding the progress of the trial before the learned Metropolitan Magistrate, I am of the view that the pendency of the revisional application is unwarranted in the facts and circumstances of the case as
more than 12 years have elapsed since the institution of the complaint.
Accordingly, the present revisional application being CRR 767 of 2012 is dismissed.
All pending applications, if any, are consequently disposed of.
