Petitioner is aggrieved by the fact that the private 26.03.2025 Court No. 35 Item No.12 Rakib respondents and their members being respondent nos. 10 to 15 are forcefully using the land of the petitioners without taking any permission. Further when the petitioners have informed the administrative authority, the administrative authorities are also not enforcing the clause that without the permission of the owner of the land no public function can be organized at his property. So far as the present writ petition is concerned the same relates to a function which is already over. I have considered the report submitted by Inspector-in-Charge, Arambagh police station dated 17.03.2025, henceforth, I direct that in case any permission is sought for from the SDO, Arambagh, the SDO Arambagh will asses regarding the ownership of the property and insist the applicant to take permission from the owner of the property.

If the petitioner is the owner of the property, in that case his permission would be sought for by the applicant and thereafter the SDO, Arambagh will give the permission.

With the aforesaid observations, WPA 5884 of 2025 is disposed of.

Report submitted by the State be kept with the record.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
