Petitioner is aggrieved by the fact that even after obtaining the sanctioned plan from the municipality, he is unable to raise the construction as there has been unnecessary interference by the police authorities on the basis of informations furnished by the private respondents. Attention has also been drawn in respect of the order passed in T.S. 262/2024 which was initiated at the behest of respondent no. 5 wherein initially ad interim injunction order was allowed. The said ad interim order was consequently vacated.

Be that as it may, the police report reflects that the property is undemarcated, as such all the co-sharers are at loggerhead.

In view of the aforesaid petitioner would approach the appropriate authority or the civil court

for rendering police assistance on the basis of the documents in his possession.

Police authorities would for the time being ensure that there is no breach of the peace and/or tranquility and/or any untoward incident arising from the strained relationship of the parties. With the aforesaid observations WPA 5912 of 2025 is disposed of.

Report so submitted be kept with the record.

A copy of the report be handed over to the learned advocate appearing for the petitioner. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
