Petitioner is directed to serve a copy of the revisional application upon Mrs. Sujata Das, learned advocate who ordinarily appears on behalf of the State. Her appointment may be regularized by the concerned Authorities in due course The present application has been preferred under Section 407 of the Code of Criminal Procedure praying for transfer from the court of the learned Judicial Magistrate, Barasat to the learned Judicial Magistrate, Raiganj.

The plea on behalf of the petitioner is that the petitioner is a military personnel who only gets eight days of casual leave. Having regard to the plight expressed by the petitioner, I am of the opinion that this is not a fit ground for transfer of the proceedings. However, if the petitioner files an application under Section 317 of the Code of Criminal Procedure for the purposes of progress of the trial in his absence, learned Judicial Magistrate, 1st court, Barasat would allow the same on the particular date

concerned.

No interference is made in respect of the prayers so advanced.

With the aforesaid observations, the present revisional application being CRR 918 of 2023 is disposed of. Pending applications, if any, are consequently disposed of.
