Although we do not find any reason to interfere with the order passed by the learned Land Reforms and Tenancy Tribunal as the appeal was ex facie time-barred and the averment with regard to limitation was erroneous, however, for the ends of justice, we permit the petitioners to file an application for condonation of delay.

In the event such application is filed within a period of two weeks from date, the order dated 6th March, 2020 shall stand set aside and the learned Tribunal, in such event, shall consider the prayer for condonation of delay in filing the original application before the West Bengal Land Reforms and Tenancy Tribunal. The Tribunal shall consider the application for condonation of delay on merits without being influenced by the observation made by us. The petitioners shall also suitably amend Paragraph 5 of O.A.544 of 2018 (LRTT).

With the aforesaid observation, the writ petition being WPLRT 12 of 2021 stands disposed of.
