Kausik (Rejected) CRM (NDPS) 488 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Lalgola Police Station Case No. 496 of 2022 dated 23.12.2022 under Sections 21(C) of the NDPS Act.

Learned advocate appearing for the petitioner submits that the independent prosecution witnesses did not support their case and the last of the witness was examined on 06.03.2025.

Learned advocate for the State has submitted a report. However, the same is not very inspiring as the contention of the learned Advocate for the petitioner seems to confirm that for a period of 1 year no witness has been examined. Earlier there was a direction by this Court on 11th December, 2025 in CRM (NDPS) 1228 of 2025 to conclude the trial by 6 months as 7 witnesses are left to be examined. Prosecution seems to be ignorant about the orders passed by this Court.

Superintendent of Police, Murshidabad Police District would ensure that within the aforesaid time period rest of the witnesses are produced before the learned Special Court. Since the earlier direction still persists, the application being CRM (NDPS) 488 of 2026 is dismissed.

Learned advocate for the State would communicate this order to the learned Special Court as well as the learned Public Prosecutor conducting the case.

Learned advocate for the State is also directed to communicate the order to the Office of the Superintendent of Police, Murshidabad Police District.

Memo of evidence submitted by the State be kept with the record.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
