Re: CAN 1 of 2024 (Modification)

1. Affidavit-of-service filed in Court today be taken on record.

2. Modification is sought of the order dated 1st April, 2024. There are some errors of calculation, which could not be placed on the said date before this Court when the order was passed. Paragraphs 7 and 8 of the said order shall stand deleted and be replaced with the following paragraphs:

"7.

In the above circumstances, this Court directs the Director of Pension, Provident Fund and Group Insurance, West Bengal to pay a sum of Rs.57,08,692.00 to the 17 employees minus and except Sankar Das, who retired on 31st January, 2023 in accordance with the calculation in the resolution of Ramakrishna Mission Ashram, Narendrapur dated 20th February, 2023,

together with further interest from 1st April, 2022 till the date of actual payment at the rate of 7% per annum within a period of one month from date. In default, the rate of interest shall stand increased to 9% per annum.

In so far as Sankar Das is concerned, let the interest be paid on the amount of Rs.12,32,357/- from 1st April, 2023 till the date of actual payment at the rate of 7% per annum also within a period of one month from date. In default, the rate of interest shall stand increased to 9% per annum."

3. The order dated 1st April, 2024 shall stand modified accordingly. The application being CAN 1 of 2024 shall stand disposed of.

4. There will be no order as to costs.

5. All parties are directed to act on a server copy of this order duly downloaded from the official website of this Court.
