An affidavit-of-compliance has been filed by the Registrar, Bidhan Chandra Krishi Viswavidyalaya. The statement of payment of the petitioner is annexed to the said affidavit.

The petitioner has filed an exception to the affidavit-of-compliance. The petitioner alleges erroneous calculation on the part of the University in making payment.

I am of the opinion that the fact of erroneous calculation at the time of making the payment cannot be ascertained in the contempt application. The same gives

rise to a fresh cause of action which cannot be adjudicated in the contempt proceeding.

It will be open for the petitioner to file appropriate proceeding before the competent Court for redressal of his grievance, if so advised.

The contempt application stands disposed of.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
