Affidavit-of-service filed on behalf of the petitioner is taken on record.

The grievance of the petitioner is inaction on the part of the concerned police authorities in registering FIR based on the complaint dated 28th February, 2026. Petitioner prays for direction upon the concerned police authorities to take steps in accordance with law taking note of the said complaint dated 28th February, 2026.

Learned advocate representing the State respondents has filed a communication dated 15th March, 2026 of the Officer-in-Charge, Burtolla PS, Kolkata and same is taken on record.

On perusal of the said communication dated 15th March, 2026 it appears that dispute between the petitioner and the private respondents centers around monetary transaction to the tune of Rs.1,08,15,000/- out of which according to the police authorities Rs.65,00,000/- has been paid

and rest is remaining due.

Considering the submissions made on behalf of the respective parties and the contents of the communication dated 15th March, 2026 it appears that petitioner is aggrieved by non-payment of the sum which was given as loan to the private respondents.

If issue relates to loan, petitioner needs to approach the appropriate forum in pursuit of the remedy. However, in this writ petition prayer is made for registering FIR based on complaint dated 28th February, 2026.

If necessary steps are not taken by the police authorities petitioner is required to approach jurisdictional Magistrate under Section 175 vis-àvis Section 210 of BNSS 2023. 8.

Hence, writ petitions stands dismissed.

However, this order shall not preclude the petitioner to take steps in accordance with law. (Saugata Bhattacharyya, J.)
