The petitioner complains that Baguiati Police Station has not investigated a complaint against the private respondent no. 7. Baguiati Police Station has registered FIR being P. S. Case No. 142 of 2023 dated 18.03.2023 under Sections 417/376 of the IPC. 2.

The petitioner also submits that the Police have not been able to recover sum of Rs.3,50,000/- from the private respondent no. 7.

Counsel for the respondent no. 7 also denies having received any sum of money of Rs.3,50,000/- from the petitioner.

Counsel for the private respondent no. 7 submits that he has been granted anticipatory bail by the Hon'ble Supreme Court on 18.05.2023 in Appeal (Criminal ) No. 6180 of 2023.

Counsel for the respondent no. 7 submits that certain personal and private photographs of the

petitioner and the private respondent no. 7 are annexed to the writ petition.

This Court does not deem them to be necessary for the purpose of adjudication of the proceedings. They need not remain on record.

The officer of this Court shall remove the said photographs starting at page 28 until page 32 from the records of the instant writ petition and return to the same to the writ petitioner.

Parties may institute appropriate civil proceedings to recover any sum of money that may have been given by one to the other.

9.

Baguiati Police Station shall complete investigation into the FIR within a period of two months from date.

The writ petition is disposed of.

There will be no order as to costs.

12.

All parties are directed to act on a server copy of this order duly downloaded from the official website of this Court.
