Mr. Dilip Kumar Maiti ... for the petitioner Mrs. Sanghamitra Nandy Ms. Manika Pandit ... for the State The petitioner claims to be the unmarried daughter of a deceased Primary School Teacher. The teacher died on 10th April, 2021. The mother of the petitioner predeceased her father on 16th March, 2021. The petitioner made an application for grant of family pension to unmarried daughter on 16th April, 2021.

The petitioner's grievance is that the said application has not been considered till date. As it appears that the application of the petitioner praying for grant of family pension to the unmarried daughter is pending consideration at the end of the District Inspector of Schools, Primary Education, Nadia. Accordingly, the instant writ petition is disposed of directing the respondent no.2 being the District Inspector of Schools, Primary Education, Krishnanagar,

Nadia to take a decision with regard to application made by the petitioner for grant of family pension to unmarried daughter in accordance with law at the earliest and positively within a period of eight weeks from the date of communication of this order. The said respondent shall pass a reasoned order and communicate the same to the petitioner immediately thereafter.

It is made clear that this Court has not gone into the merit of the case and all points are kept open and to be decided at the time of consideration of the representation of the petitioner.

The petitioner is directed to forward a copy of all the relevant documents along with her application for grant of family pension to the aforesaid respondent at the time of communicating the order of the Court. The writ petition stands disposed of.

Urgent photostat certified copy of this order be supplied to the parties, if applied for, as early as possible.
