The State is not represented today despite the matter having been specifically fixed for hearing. This is an assigned matter, which is pending consideration for quite some time.
The petitioner prays for consideration of the representation at Annexure P-3 and Annexure P-4 of the writ petition, where she has contended that 2 cottahs 6 chittacks of land at R.S. Dag No.417, R.S. Khatian No.153/1, Mouza Madurdah is free from requisition by the Fisheries Department of the West Bengal. A status report has already been filed by the State.
In the backdrop of the above, the respondent No.2, the Special Land Acquisition Officer, shall consider the representation of the petitioner at Annexure P-3 and Annexure P-4 of the writ petition strictly in accordance with law and dispose of the same within a period of one month from the date of communication of a copy of this order mandatorily and positively.
The respondent Nos.2 and 3 may also consider accepting Khajna from the petitioner without prejudice to the rights and contentions of any of the parties. With the aforesaid directions, the writ petition shall stand disposed of.
In view of the disposal of the main writ petition connected applications, if any, shall also stand disposed of.
There shall be no order as to costs.
All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
