The matter is listed today for hearing as "Contested Application". On call none appears for the petitioner and for opposite parties. Petitioner filed this revisional application under Section 482 of the Code of Criminal Procedure praying for quashing/setting aside of impugned order dated 03.07.2014 passed by Learned Executive Magistrate, Barasat (Sadar), North 24 Parganas in M.P. Case No.1960 of 2013 under Section 144(2) of the Code of Criminal Procedure.
Perused the application for revision and the impugned order. The impugned order was passed by the Learned Executive Magistrate whereby the earlier dated 09.01.2014 for providing electric connection to the premises of the petitioner was vacated.
In my considered opinion, as per provision under Section 144(4) of the Code of Criminal Procedure, an order passed under Section 144 remains valid for 60 days. Therefore, the impugned order has no force and the present application has become infructuous.
Thus the revisional application is dismissed. Interim order, if any, stands vacated.
Let a copy of this order be communicated to the Learned Executive Magistrate, Barasat (Sadar), North 24 Parganas for information.
