Mr. Swarnali Saha ... for the Petitioners The petitioners complain that the private respondent is making construction without obtaining a sanction plan and in violation of the order passed by the learned 5th Civil Judge, Senior Division at Alipore in Title Suit No.1188 of 2021.

The allegation of making construction without a sanction plan has never been forwarded to the respondent Corporation. The objection filed by the petitioners before the Corporation does not speak about construction being made without a sanctioned plan. It will be open for the petitioners to file a comprehensive representation before the Executive Engineer of the jurisdictional Borough highlighting all the grievances.

In the event such a representation is made, the same shall be considered strictly in accordance with law after

giving reasonable opportunity of hearing to the petitioners and all other necessary parties.

A reasoned order shall be passed and communicated to the parties.

Affidavit of service filed in Court is taken on records. Writ petition stands disposed of.

Urgent photostat certified copy of this order, if applied for, be given to the parties on completion of usual formalities.
