In Re: CAN 1 of 2024 Learned Advocate appearing for the petitioners at the inception submits that he do not intend to press CAN 1 of 2024.

Accordingly, CAN 1 of 2024 is dismissed as not pressed.

In Re: WPA 6365 of 2024 Petitioners are aggrieved by the fact that in spite of the civil court having passed status quo order their peaceful possession is being disturbed at the behest of the private respondents. Petitioners also complained that they are unable to raise construction in a land which has been purchased by them, to that effect the petitioners have informed the police authorities but the police authorities still did not take any action.

Mr. Mondal, learned Additional Government Pleader appearing on behalf of the State has submitted a report. Report reflects that there has been a stop work

notice issued by Berhampore Municipality. It has also been apprised by the police authorities that the petitioners has not informed the status quo order to the police authorities concerned.

In view of the same, I grant liberty to the petitioners to approach the municipal authorities so far as the stop work order is concerned and if there has been a status quo order passed in connection with T.S. No. 80 of 2024 the order along with a fresh representation be furnished before the Officer-in-Charge, Berhampore Police Station. The Inspector-in-Charge would ensure that there is no breach of the peace at locale at the behest of the private respondents, in case there is a status quo order passed by the civil court.

With the aforementioned observations, the instant writ petition being WPA 6365 of 2024 is hereby disposed of.

Report be submitted be kept with the record.

Copy of the report be handed over to the learned Advocate appearing for the petitioner.

Parties shall act on the basis of the server copy of this order duly downloaded from the official website of this Court.
