09.01.2023 S/L No.17 KS C.R.R. 694 of 2021 Sri Dulal Chakraborty -Vs.- The State of West Bengal & Anr.

Ms. Manisha Sharma .....For the State The present revisional application was preferred challenging the continuance of Belgharia Police Station Case No.804 of 2019 dated 20.11.2019 under Sections 498A/ 323/ 324/ 406/ 506/ 120B/ 34 of the Indian Penal Code and Sections 3/ 4 of the D.P Act. As none appears on behalf of the State, Ms. Manisha Sharma, learned advocate who ordinarily appears on behalf of the State is directed to represent the case on behalf of the State. Her appointment may be regularized by the concerned authority. On perusal of the records of the revisional application, it reflects that although the proceedings were challenged but certified copy of the F.I.R. as well as the chargesheet were not enclosed alongwith the revisional application and only the certified copy and a photostat copy of the prayer for discharge have been enclosed. Earlier when the matter appeared on 09.03.2021 there was an undertaking by learned advocate appearing for the petitioner and the same till date has not been complied with.

Having considered the same, I am of the opinion that there is no serious persuasion by the petitioner before this Court in the present revisional application. Further pendency of the revisional application is, as such, uncalled for. Accordingly, C.R.R. 694 of 2021 is dismissed. Pending applications, if any, are consequently dismissed. All parties are directed to act on the server copy of this order downloaded from the official website of this Hon'ble Court.
