The petitioner claims that his lands comprised in L.R. Plot Nos. 482, 483, 489, 484, 485, 487, 471, 472, 473, 475 and 476 under Mouza Kashtala, Sagar (1), Sub-Division of Kakdwip (1) Division, J.L. No. 004, L.R. Khatian No. 185 have been acquired for the construction of ring Bundh along with river bank of Muriganga damaged by 'Amphan' cyclone, but no compensation has been paid to him. The petitioner through his learned advocate gave the representation dated January 19, 2021 praying for compensation to the Sub-Divisional Officer, Irrigation Department, a copy whereof was also sent to the Superintending Engineer, Eastern Circle, Irrigation and Waterways Directorate, District 24 Parganas (North) the respondent no. 2 herein.

The grievance of the petitioner is that the said representation has not been considered by the said authorities till date.

Mr. Soumitra Bandyopadhyay learned advocate for the State respondents submits that the respondent no, 2 is the

appropriate authority to consider the said representation of the petitioner.

W.P.A. 6869 of 2021 is disposed of by requesting the said respondent no. 2 to consider and dispose of the said representation of the learned advocate for the petitioner which is appearing at page 28 of the writ petition being 'Annexure P-9' in accordance with law by a reasoned order expeditiously, preferably within a period of twelve weeks from the date of communication of this order, if necessary, after giving the petitioner an opportunity of being heard. The petitioner is required to serve a complete copy of the writ petition upon the respondent no. 2 within a week from date.

The respondent no. 2 after disposal of the said representation shall communicate his order to the petitioner.

Since no affidavit-in-opposition has been invited the allegations made in the writ petition are deemed to have been denied by the respondents.

No order as to costs.
