The petitioner took admission in B.A. (Honours) Course at South Malda College under the University of Gour Banga.

During the academic session 2008-2009 the petitioner could not pass the Sociology paper in Part I examination.

However, she cleared her Part II examination in the following year.

Since the petitioner could not clear the Sociology paper of Part I, she was not declared as a passed candidate by the University.

It has been submitted on behalf of the petitioner that the petitioner is a destitute woman. Because of matrimonial discord, she is currently living with her three children in her matrimonial home. The Court should permit the petitioner to take the supplementary Sociology paper as a special case.

Regrettably, considering that fourteen years have elapsed from date of initial examination, this prayer cannot be entertained, despite sympathetic inclination towards the petitioner.

However, it is expected that if the petitioner applies for admission to the College for enrolling herself in the said course afresh, her prayer should be considered sympathetically by the College as well as by the University.

With the aforesaid directions, WPA 6084 of 2023 is disposed of.
