Petitioner complains of being physically tortured at the behest of the private respondent nos.7 and 8 who happen to be the grandsons of the petitioner. Since such physical torture was inflicted upon the petitioner and his wife, information was furnished to the police authorities. However, police authorities till date did not take any action. State has submitted a report. Report reflects that the police authorities considered this to be a family dispute still they have drawn up proceedings under Section 107 of the Cr.P.C.

I have considered the submissions of the learned advocate appearing for the petitioner and on assessment of the same, I direct that since the petitioner and his wife are the senior citizens, they

would approach the jurisdictional SDO under the provisions of Maintenance of Welfare of Parents and Senior Citizens Act, 2007. If the Sub-Divisional Officer passes any direction, police authorities would respect, obey and implement such order. In the meantime, police authorities would keep a strict vigil and ensure that no untoward incident results because of such strained relationship between the parties.

With the aforesaid observations, WPA 6089 of 2023 is disposed of.

There will be no order as to costs.

Report submitted by the State be kept with the record.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
