The report reflect that the present petitioner was also not present on the earlier date so fixed and a prayer has been advanced before this court for expeditious disposal of the case on behalf of accused person when majority of the accused persons are selectively appearing. The case is of the year 2006. 17 years have passed and the investigating authority/prosecution intends to rely upon 29 witnesses to prove its case.

It has been informed that till date charge has not been considered.

The ld. Magistrate on the next date fixed, which has been informed to be 28th of June, 2024, would modify the order of bail of the accused, who are absent, as the trial has

already been delayed by 17 years. Steps be taken for consideration of charges after supply of the documents within 60 days from the next date so fixed.

The ld. Trial court would thereafter fix one date in every fortnight so that the trial progresses. All efforts be taken so that within a year, at least, 15 witnesses are examined between August, 2024 and August, 2025. It has been submitted in the report that the documents are available with the Detective Department, so all the documents under section 207 of the cr.p.c. be supplied before the ld. Magistrate on call and, at the time of evidence, all the documents relating to the case may be made available to the ld. Public Prosecutor conducting the case.

With the aforesaid observations, CRR 976 of 2024 is disposed of.
