However, State respondents and West Bengal Board Madrasah Education are represented by learned advocates.
It is submitted by the learned advocate representing the petitioner that disciplinary proceeding was initiated against the petitioner and petitioner was placed under suspension.
Ultimately petitioner was exonerated from charges resulting in resumption of duty by the petitioner as Assistant Teacher of Badulara Sammilani High Madrasah, Bankura. It is further submitted in reference to two documents at pages
45 and 46 of the writ petition that the District Inspector Schools (SE) Bankura has determined the entitlement of the petitioner to receive arrear dues towards arrear salary adjusting subsistence allowance. Rs. 2655384/- was found to be payable to the petitioner as it emanates from two memoranda both dated 21st February, 2024. In the memorandum dated 21st February, 2024 being no. 339/S it is further stated by the District Inspector of Schools (SE) Bankura that arrear bill has been checked by the concerned District Inspector of Schools and was vetted by the Joint Director of Accounts, (Education Deptt.) Bankura.
Prayer is made on behalf of the petitioner to release arrear dues in terms of memo dated 21st February, 2024 issued by the District Inspector of Schools (SE) Bankura expeditiously.
Learned advocate representing the State respondents submits on instruction that proposal has already been sent to the Director of Madrasah Education, West Bengal for allotting fund which would enable the concerned District Inspector of Schools (SE) to release the arrear dues. Since fund has not yet been allotted payment could not be made in favour of the petitioner.
Having considered the respective submissions made on behalf of the parties writ petition stands disposed of directing the Director of Madrasah Education, West Bengal being respondent no. 2 to allot fund based on memo dated 21st February, 2024 issued by the District Inspector of Schools (SE) Bankura being no.
339/S by fortnight from the date communication of this order. On fund being allotted the District Inspector of Schools (SE) Bankura being respondent no. 4 is directed to release the amount in favour of the petitioner by fortnight thereafter.
Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
