It is submitted on behalf of the petitioner that they are in financial difficulty and cannot make payment of the outstanding amount.
None appears on behalf of the private respondent nor is any adjournment prayer for. The State is represented.
In view of the clear statutory embargo under the provisions of SARFAESI and, more particularly, under Section 17 of the Act of 2002, there is no scope of interference by the Writ Court.
WPA 6081 of 2026 stands dismissed.
Liberty is granted to the petitioner to approach the available statutory remedy in
accordance with law. It is made clear that there has been no adjudication on the merits of the case and all questions are left open to the adjudicated by the Appropriate Tribunal to decide. (Ravi Krishan Kapur, J.)
