The petitioner complains that the private respondents have effected construction over a land in front of the petitioner's residence which construction is encroaching upon the P.W.D's road and obstructing ingress and egress into the shop of the petitioner. The State, particularly PWD (Roads) has filed a report dated 6th September, 2021, addressed to the Government Pleader.

The report of the Executive Engineer, Nadia Highway Division-I PWD (Roads) dated 6th September, 2021 is taken on record.

It appears from such report that the land on which construction is being made by the private respondents does not belong to the PWD.

In view of the above, WPA 4861 of 2020 is disposed of without any orders.
