Ms. S. Das .....For the State The present revisional application was preferred challenging the continuance of Baduria Police Station Case No.77 dated 17.03.2009 under Sections 376/ 302/ 201 of the Indian Penal Code which was renumbered before the Learned Fast Track - III Court at Basirhat being, ST No.55 (12) 12.

As none appeared on behalf of the State, Ms. Sreeparna Das, learned advocate who ordinarily appears on behalf of the State is directed to represent the case on behalf of the State. Her appointment may be regularized by the concerned authority.

The contention advanced in the revisional application was for expeditious disposal of the trial of the case. There has been no persuasion on behalf of the petitioner since the said revisional application was preferred before this Court. Records reflect that earlier the matter appeared on 16.04.2021 before a Co-ordinate Bench when none represented on behalf of the petitioner.

Having regard to the contention expressed by the petitioner, I direct that in case the trial of the case has not been concluded till date, the learned Sessions Court is directed to take steps so that the trial of the said case is

concluded within a period of six months from the date of communication of this order. Learned Trial Court to that extent will fix a schedule consisting of three dates and every 15 days such schedule should be fixed. If required, the Learned Trial Court will engage the Inspector-inCharge/Officer-in-Charge of Baduria Police Station to act as the Nodal Officer and organize the attendance of the witnesses on the date so fixed. No unnecessary adjournment should be granted to either of the parties. If the accused persons are found absconding and some of them are appearing before the Court, the Learned Trial Court would be at liberty to segregate the case so that the same is completed within the time schedule referred to above.

With the aforesaid observations, C.R.R. 699 of 2021 is disposed of. Pending applications, if any, are consequently disposed of. Department is directed to communicate this order to the Learned Trial Court within a period of 10 days from date.
