The revisional application is listed today as contested application. On call none appears for the petitioner and for opposite parties. The petitioner/husband filed this revisional application under Section 401 read with Section 482 of the Code of Criminal Procedure assailing order dated 12.01.2010 passed by Learned Additional Sessions Judge, Fast Track 3rd Court, Tamluk dismissing the prayer of the petitioner in Criminal Revision Case No.27 of 2009 arising out of Misc. Case No.55 of 2009 under Section 125 of the Code of Criminal Procedure.
The petitioner had filed the revisional application before Learned Additional Sessions Judge, F.T.C., Tamluk being aggrieved with the order of interim maintenance of Rs.600/- per month allowed in favour of wife and Rs.400/- to the minor child. There is no dispute regarding the marriage.
Since filing of this application, on 03.03.2010, the petitioner has not turned up. No notice has been served upon the opposite party no.2.
Perused the impugned order. I find no illegality, irregularity or impropriety in the impugned order whereby the order of interim maintenance allowed in favour of the legally married wife and the minor child was affirmed with lapse of time the contention in the application has lost its force.
The revisional application is without merit and the same is dismissed.
There is no interim order.
