Report submitted by the State is taken on record. Heard learned counsels for the parties.
It appears that the petitioner has surrendered before the learned trial Court in terms of the order dated 10th April, 2025 and is continuing in custody.
Learned counsel for the petitioner submits that the petitioner is in custody for more than 5 months. The incident occurred on the spur of the moment and the petitioner had no intention to inflict grievous injury upon the victim. Charge sheet has been submitted and further detention of the petitioner is not required. The petitioner prays for bail.
Opposing the prayer, learned counsel for the State submits that the victim has succumbed to his injuries on
14th April, 2025 and a supplementary charge sheet is required to be submitted in this regard.
Learned counsel submits that the alleged incident was a deliberate act on the part of the petitioner to avenge the victim who had eloped with the petitioner's wife and married her.
I have considered the material on record. Statement of witnesses suggests prima facie nexus of the petitioner with the alleged offence.
Considering the material in the case diary, gravity of the offence and prima facie involvement of the petitioner in the alleged offence, the prayer for bail is rejected at this stage.
The application for bail is thus disposed of. Case diary be returned.
