1. The parties are not represented.
2. This application under Article 227 of the Constitution of India was filed on 24th February, 2012 challenging the order of learned trial court passed on 17th January, 2012 accepting thereby the report of learned Commissioner appointed to effect partition in terms of the preliminary decree. Since filing, as the record reveals the petition was never moved.
3. Under such circumstances, I do not find any reason to keep the lis pending. Let it be dismissed being infructuous.
4. The application, if any, stands disposed of.
5. Department is directed to communicate this order to the learned trial court immediately for information and necessary action.
