D/L Item No. 28 29.06.2021 (Video Conference) Kole WPA 6882 of 2021 Rupasree Bhowmik -Vs.- The State of West Bengal & Ors.

Mr. Kalyan Kr. Chakraborty, .... For the petitioner.

Mr. Amitesh Banerjee, Mr. S. Adak, ... for the respondents.

The Counsel for the State, Mr. Banerjee, has filed a report including a statement of facts. The investigation has not yet been completed. It is, therefore, rather premature for the Court to come to any finding as regards the action or inaction on the part of the Police Authorities. It is, however, directed that the investigation be completed by the I.O., Chhatna Police Station, Bankura, within a period of one month from date positively.

A copy of the final report may be submitted to the jurisdictional Magistrate and a copy may be furnished to the writ petitioner. The petitioner shall be entitled to take appropriate steps including filing a naraji petition, if he is dissatisfied with the final report. A copy of the report filed in Court is kept with the record, prior service thereto has been made to the Counsel of the writ petitioner. It is made clear

that the prayer of the writ petitioner for transfer of investigation to CID or CBI, is therefore premature. The issue may be agitated by the petitioner in accordance with law at a later.

With the aforesaid directions this writ petition is disposed of. There shall be no order as to costs. Certified photocopy of this order, if applied for, be supplied to the parties upon compliance of necessary formalities.
