1. Affidavit of service and the notice of upgradation filed in Court today are taken on record.

2. The petitioner complains that despite satisfactory completion of the work in terms of the work order being Memo No. - 791/B dated 26th May, 2022 issued by the Block Development Officer, Contai-I Development Block, full and final payment has not been made.

3. The tender amount was Rs. 29,86,296/-. Hand over certificate was issued by the Block Medical Officer of Health, Majna Block Primary Health Centre in February, 2024.

4. The Block Development Officer vide communication dated 22nd February, 2024 requested the Additional District Magistrate (ZP) (Health) to release amount of Rs. 21,74,894/- for payment.

5. The petitioner prays for a direction upon the respondent authorities to release the balance payment.

6. There is no positive instruction from the respondent authorities with regard to the balance payment claimed by the petitioner.

In view of the above, the instant writ petition is disposed of by directing the Additional District Magistrate, (Zilla Parishad), Purba Mednipur being the respondent no. 3 and the Block Development Officer, Contai-I Development Office being the respondent no. 8 herein to take steps to release the balance payment in favour of the petitioner in accordance with law at the earliest, but positively within a period of sixteen weeks from the date of communication of this order.

8. If any portion of the claim of the petitioner is found to be disputed, the same shall be immediately intimated to the petitioner so that the petitioner may take further steps in the matter.

9. Learned advocate for the petitioner is directed to forward copy of all the relevant documents in support of the subject claim to the aforesaid respondent at the time of communicating the order of the Court.

10. It appears that the petitioner sought for relief with regard to two work orders in one writ petition. The instant writ petition is being restricted only to the work order for construction of Band Gobindapur Susasthya Kendra under Badalpur GP within Contai-I Development Block.

11. It will be open for the petitioner to pursue the claim with regard to the other work order in a different proceeding.

12. The writ petition stands disposed of.

13. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all the requisite formalities.
