Petitioner is in custody for 400 days. He prays for bail. Learned Advocate for the State opposes the bail prayer. We have considered the materials on record. Petitioner was a member of the unlawful assembly who were variously armed and assaulted the victim. As a result, he died. Bail prayer of co-accused viz., Bijoy Patar @ Bijay Patar was turned down by this Court in February, 2023. Trial is in progress. Under such circumstances, we are not inclined to grant bail to the petitioner.

Accordingly, the prayer for bail of the petitioner is rejected.
