(Through Video Conference) Mr. Biswabrata Basu Mallick Mr. Pradip Paul ... ... for the petitioners Mr. Jahar Lal De Mr. Sutanu Chakrabarti ... ... for the State The case of the petitioners is that there is a pond measuring about 1 acre 22 decimals under Mouza - Manikpur, JL No. 417, Plot No. 597 within the ambit of Palshya Gram Panchayet, Paschim Medinipur which has been given by the Pradhan and other officer bearers of Gram Panchayet on lease to the respondent no. 8 without following any lawful process or adopting the tender process.

The grievance of the petitioners is that the lease has been granted by the official respondents to the private respondent for personal gain.

When the matter is taken up today, learned counsel for the petitioners has submitted that a detailed representation in the form of communication dated 27.01.2021 has already been sent to the respondent 2, District Magistrate, Paschim Medinipur but no action has been taken till now.

Learned counsel for the State fairly submits that there is no objection in considering the grievance of the petitioners as raised in the representation.

Hence, the present writ petition is disposed of at this stage directing the respondent no. 2 to duly consider the petitioners' representation dated 27.01.2021 as expeditiously as possible, preferably within a period of three months from the date of receipt of certified copy of this order.

If any illegality is found by respondent no.2, as alleged by the petitioners, then he will take due action in accordance with law against the persons responsible for committing the said illegality.
