Mr. Sabir Ahmed, Mr. Simanta Kabir ...for the State The writ petitioner filed the present application alleging that his wife and minor son had been kidnapped by the respondent no.5. A complaint lodged to that effect was registered but no steps had been taken by the police authorities.

Today, no one appears on behalf of the petitioner. Mr. Ahmed, learned advocate appearing for the State submits, upon instruction, that the petitioner's wife and minor son were recovered and the respondent no.5 was arrested. The petitioner's wife was also produced before the learned Judicial Magistrate, 4th Court, Durgapur on 19th April, 2022 and her statement under Section 164 of the Code was recorded. Presently, the petitioner's wife and her minor son are residing with the petitioner at Panagarh Railpar, Police Station Kanksa, District-Paschim Bardhaman. Let the written instruction, as produced, be kept on record.

As the petitioner's wife and minor son had already been recovered and are residing with the petitioner, no further order is required to be passed in the present application and the same is accordingly, disposed of. Urgent photostat certified copy of this order, if applied for, be supplied to the parties, upon compliance of all requisite formalities.
