Learned advocate appearing for the petitioner submits that petitioner is a teacher who has been implicated on the grounds of threatening the victim and not divulging the incident to others.

Learned advocate for the State has produced the case diary and drawn the attention of the Court to the statement of the victim under Section 183 of the BNSS.

Learned advocate for the defacto complainant opposes the prayer for bail on the ground that the present petitioner was fleeing away from the process of law for 7 years. As has been submitted by the learned advocate for the State that the examination-in-chief of 3 witnesses have been completed but their cross-examination is yet to commence, taking into account the facts of the case as also the locus of the present petitioner in relation to the charges which have been framed, I am of the opinion that petitioner should not be released on bail at this stage. However, after the crossexamination of the 3 witnesses whose examination-in-chief has been completed, learned Trial Court would release the petitioner on bail who is in custody for about 250 days. The next date as has been informed is fixed on 10th April, 2026. Learned Trial Court would put in efforts to complete the cross-examination by 31st July, 2026.

With the aforesaid observations CRM (M) 682 of 2026 is disposed of.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
