Learned advocate for the petitioner submits that the petitioner is in custody for more than 1 year 5 months, till date charges have not been framed and the petitioner is unnecessarily languishing in jail.
Learned advocate for the State opposes the prayer for bail and submits that a sum of around Rs.98 lakhs were transmitted to the account of the present petitioner. Subsequently, the same were withdrawn by way of cash and the amount which has been siphoned by the other accused persons who are in conspiracy with the present petitioner belongs to the pension fund and the said quantum is Rs.3.33 crores.
Having regard to the subject matter of the case as also that charge-sheet has been submitted in December, 2024 and till
date there has been no progress, I direct the learned trial court to split up the trial of the case at the earliest, preferably within a period of three months as it has been submitted by the investigating officer present in Court that the prayer for warrant proclamation attachment is pending. So far the warrant proclamation attached is concerned within a period of 60 days the learned trial court would exhaust whole of the process, if required, split up the trial of the case and by 1st week of July, 2026 proceed for consideration of charges. At this stage, the prayer for bail of the petitioner is rejected. Petitioner will renew his prayer for bail after the stage of consideration of charges are over by the learned trial court. With the aforesaid directions, CRM(M)685 of 2026 is dismissed.
Pursuant to the earlier direction, the investigating officer is present. His further appearance before this Court is dispensed with.
