Ms. S. Das .....For the State The revisional application was preferred challenging the continuance of Santipur Police Station Case No.3 of 2021 under Sections 417/ 376 of the Indian Penal Code pending before the Learned A.C.J.M., Ranaghat, Nadia. The revisional application is pending before this Court for more than one and half years and the stage at which the petitioner approached this Court as is reflected from the record of the present revisional application is at the stage of investigation.

Having considered the passage of time passed during pendency of the present revisional application, I am of the opinion that there is bound to be change of circumstances in view of the investigation progressing during pendency of the revisional application for the last one and half years. Ms. Das, learned advocate appears on behalf of the State. Having considered the stage at which the petitioner approached this Court, progress of the investigation during the period of one and half years and there being no persuasion on behalf of the petitioner, I am of the opinion that further pendency of the proceedings before this Court is unwarranted. Accordingly, C.R.R. 703 of 2021 is dismissed. Pending applications, if any, are consequently dismissed.
