For the State The petitioner initially sought parity with co-accused Bishal Saren who has been granted bail by this Court. Learned counsel for the State submits that the State has prayed for cancellation of bail of Bishal Saren which is pending before this Court.

The petitioner seeks to make submission independent of the bail granted to the co-accused.

Learned counsel for the petitioner takes this Court to the serological report of the wearing apparel and offending weapon seized from the petitioner. The report suggests that the blood stain in the said articles was insufficient to arrive at a conclusion.

Opposing the prayer, learned counsel for the State submits that the motor bike of the deceased was recovered pursuant to the leading statement of the petitioner and another. Only three witnesses are left to be examined and it will not take much time for the trial to complete.

I have considered the material on record. The petitioner is in custody for about a year. Only three witnesses are left to be examined by the prosecution. Conviction shall attract mandatory life imprisonment.

Considering the material on record and prima facie involvement of the petitioner in the alleged offence, prayer for bail is rejected at this stage.

The application for bail is disposed of.
