In the present case, a reference has been made to the District Magistrate, Purba Medinipur, by the petitioner over a dispute on the allegation of the petitioner that the private respondent's electricity connection has been taken over the land of the petitioner.

It is contended that despite the reference being made by way of representation dated December 18, 2021, contemporaneously with the incident of drawing of such connection, and subsequent reminders by the petitioner, the District Magistrate is sitting tight over the matter. The allegations are disputed by the respondents.

However, it would be premature to enter into the merits of the allegations and counter allegations since the matter is pending at present before the District Magistrate. Accordingly, WPA No. 6119 of 2023 is disposed of by directing the District Magistrate, Purba Medinipur, respondent no. 2 herein, to decide the dispute referred by the petitioner, which is annexed at page 22 of the present writ petition, as expeditiously as possible in accordance with law and upon giving an opportunity of hearing to all concerned, positively within eight weeks from the date of communication of this order to the District Magistrate. The petitioner shall communicate a copy of this order, along with a fresh copy of the writ petition, to the concerned District Magistrate, upon which the District Magistrate shall act on a server copy of this order to comply with the same. There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
