(Through Video Conference) Mr. Debasis Sur ... ... for the petitioner Mr. Nilotpal Chatterjee ... ... for the State This writ petition has been filed by the petitioner seeking a direction to the concerned respondent to refund a sum of `900/- each which has been collected from the concerned persons for construction of sanitation facility. Submission of learned counsel for the petitioner is that `900/- was collected in the name of construction of house hold latrine and for sanitation work of Khatra Panchayet and the work was not done, therefore, the persons who had given the money are entitled to its refund.
The record reflects that the Block Development Officer had sent the communication dated 27.06.2017 to the Pradhan, Khatra Gram for taking appropriate measures in respect of persons whose letter was enclosed with the communication.
Learned counsel for the petitioner has informed that to some of the persons refund has been made but still there are other persons remaining who are entitled to the refund.
In this view of the matter, we permit the petitioner to file a fresh detailed representation along with the
details of the persons who are still entitled to the refund before the respondent no.7, Block Development Officer, who on receipt of the same will take an appropriate decision in accordance with law within a period of four weeks.
