No. 29 CHC Rejected C.R.M.(A) 1101 of 2023 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Kotwali Police Station Case No. 773 dated 26.10.2022 under Sections 302/120B/34 of the Indian Penal Code wherein charge sheet has been submitted under Sections 302/120B/34 of the Indian Penal Code.

And In the matter of : Sk. Khokan Ali @ Sk. Alamgir Ali & anr. ...... petitioners Mr. Navanil De, Mr. Rajeshwar Chakraborty, Mr. Srinjan Ghosh, Mr. Subhrajit Dey, Ms. Monami Mukherjee ....for the petitioners Ms. Faria Hossain, Ms. Baisali Basu, Ms. Mamata Jana ....for the State Apparently, Warrant of Arrest and Proclamation were issued and executed as against the petitioners. It is the contention of the petitioners that the issuance was bad in law.

The issuance was made on January 21, 2023 with the petitioners not taking any steps with regard thereto.

In such circumstances, we are unable to grant anticipatory bail to the petitioners.

CRM (A) 1101 of 2023 is rejected.
