Sanjib Roy @ Sanjib Ray v. State Of West Bengal
04.01.2021 Ct. 30 Sd./31 CRA 142 of 2020 With CRAN 1 of 2020(Old No. CRAN 4567 of 2020) CRAN 2 of 2020 Sanjib Roy @ Sanjib Ray vs. State of West Bengal Mr. Koustav Bagchi ..For the petitioner/appellant.
Mr. Sudip Ghosh Mr. A.K. Datta ..For the State.
This is an application for bail in connection with Criminal Appeal No. 142 of 2020.
It is submitted on behalf of the appellant/petitioner that he has been falsely implicated and invites my attention to the statement of the appellant recorded under section 313 Cr.P.C that Raju Pal, father of the victim was a drug addict and asked for money more than once and having failed to fulfill his desire, he threatened him to face dire consequences. The appellant is in custody for 76 days and right now after his conviction he has suffered sentenced for 326 days. There is little scope for the matter being heard expeditiously. Bearing in mind the nature of the offences and the term imprisonment, the prayer for bail is consider and allowed. The appellant shall be released on bail of Rs. 5,000/- with two sureties of like amount, one of whom must be local, subject to the satisfaction of the
learned Additional Chief Judicial Magistrate, Barrackpore.
Accordingly, CRAN 2 of 2020 is allowed and disposed of.
