Learned advocate appearing for the petitioner submits that the petitioner has been detained in connection with the instant case pursuant to statement of the co-accused. Petitioner is in custody for 120 days and there has been no recovery from the possession of the present petitioner. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that investigation of the case is still in progress. I have taken into account the fact that the investigation of the case is still in progress. As such, I direct the learned Special Court that in case there is no recovery in course of investigation from the present petitioner, then in that case, after submission of the charge-sheet, the petitioner may be released on bail.

With the aforesaid observations, the application for bail, being CRM (NDPS) 496 of 2026, is disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
